Keeping Alert & Your Rights

Please alert the community and other organizations you might belong to and keep an eye out.
Remember:
  • You have the right to document any arrest. You can take pictures and record video. Do it openly.
  • Even if an ICE agent tells you to stop recording, you have the right to continue recording as long as you do not interfere. You don’t have the right to interfere and you can be arrested too if you do..
  • Be aware that ICE agents might try to take your phone regardless of whether it is legal. You can invoke your rights and not consent to the taking of your phone.
  • You have the right to take notes on what ICE agents said. You have the right to collect testimonies from other witnesses. Do it immediately after witnessing an encounter
  • Share what you documented with any family or families of the individual arrested. Before posting on social media, reach out to local organizations that track ICE raids.
  • If directed to back out, back out immediately. Not complying may result in your arrest.
  • You have the right to review security camera footage
  • ICE cannot enter a residence or remove persons from a vehicle without a court order signed by a judge. Administrative orders, which is what ICE agents typically have do not give them this power. Request to see the document through a window or passed under the door if an agent states they have an order.
  • ICE frequently tries to lure people outside their home or create a false reason to enter the home to arrest the person they have targeted. They often say they are police officers.
  • Oregon is a sanctuary state, police officers cannot collaborate with ICE.
  • A person stopped in a car can refuse to have the car inspected and refuse to leave the vehicle.
  • A person arrested has the right to not answer any questions. It is wise to not answer any questions.
  • A person arrested has the right to a phone call. It is recommended to have a list of immigration attorneys and their contacts if you think you might be at risk.
